Methods of Sale

We believe there is a legal obligation for estate agents and valuers to consider all methods of sale and to advise the seller of the best option to suit their requirements. The Estate Agents Act 1979 confirms that valuers must advise clients on the best method of sale to meet their needs. Agents who consider all methods of sale will comply with the law and demonstrate their professionalism.

There are generally three methods of sale that also have sub-methods (conditional and non conditional auction sales for example). They are - Private Treaty, Tender and Auction. Currently, private treaty accounts for the majority of all property transactions in the UK.

There are also different types of sellers -

Private individuals, trustees, executors, lendors in possession, builders, developers, orders of court, public bodies, local authorities and charities.

Valuers should be aware of the different needs of these and all sellers.

Too many agents only consider private treaty without considering informal or formal tender, best and final and auction.

For some sellers the clearly laid down time-scales, date of auction and completion dates set at the point of instruction are a distinct advantage. Auction achieves the best price on the day with a binding contract formed on the fall of the gavel. This is particularly suitable when deadlines must be met, for example with estate settlement, relocation for a new job or to stave off repossession.

When a property is sold at auction there can be no question of "favours" to a particular buyer.
